The New Jersey Division of Civil Rights and Attorney General’s Office have provided guidance that clarifies how the New Jersey Law Against Discrimination offers protections against discrimination that results from the use of technology, including AI.
This guidance clarifies that the law applies to discrimination resulting from the use of automated decision-making tools (ADTs) and other technology tools. Employers will not be exempt from violation of the law simply because they rely on technology.
